Witting Accomplice/Willing Accomplice - is one of these an eggcorn?

Both make sense, but with somewhat different meanings. Both are used all over the place.
It sounds like an actual legal term or definition, though searches of legal dictionaries get me nowhere.

Are these legal terms? Is one, and not another? If one is, is the other one possibly an eggcorn?

Jorkel (I think) previously posted about unwilling versus unwitting victims, but there’s a different dynamic going on with that one.

I’m not sure of either one’s eggcornicity… It seems to me that “unwitting” is one of those words like “unruly” that is seldom if ever used in the positive. I can’t think of any other context in which we would say that someone was “witting,” meaning “knowing” or “willing.” So if I had to cast a vote one way or the other, I’d choose “witting” as the reshaping. But I can’t think of an alternative image that might arise from “witting” vs. “willing.”


Feeling quite combobulated.
