Digression for discretion

In a librarian’s listserve, no less, I came across the following, referring to the vexing questions of copyright raised by electronic publishing:

I would venture a guess that the reason they use the word “permission” is that ultimately it is at the disgression of the “owner” of the material to allow someone to use it whether a fee is charged or not.

Is this an eggcorn or just a malapropism? I’m still fuzzy about the distinction
