WAVE your rights (waive)

From the start, I would point out that ONE definition of waive is “to dismiss with or as if with a WAVE of the hand.” (“Waive a problem aside” is one figurative example). So, to avoid this usage, I directed my search to a distinct usage of “waive” by tacking on “your right(s).” (See below for details).

19,500 “wave your right” + 2440 “wave your rights”

“Waive” in the context of “relinquish voluntarily” differs from the usage where a “wave” may be operative (literally or figuratively). The distinction seems to come down to giving something up rather than dismissing it. So, if we focus on the “relinquish” definition, the word substitution “wave” constitutes an eggcorn in the sense that one is WAVING GOODBYE to the relinquished item!

It seems pretty clear that people who WAVE their rights do not know the word WAIVE. The two words sound exactly the same, though. So people probably believe that the word WAVE includes a definition (say definition number 11, way down in the dictionary) with the meaning of WAIVE. Does this make WAVE/WAIVE a lesser category of eggcorn?

Better explaination – That definition of WAVE does not exist, but people think it does. So from that standpoint, WAVE for WAIVE is very eggish. However, the two words sound exactly the same. This is not like saying EGGcorn when you mean Acorn, or like saying HEART-wired, when you mean HARD-wired.
